Privacy and Data Use Policy

These terms are effective 25 May 2018

Vocoli is an online enterprise service that allows employees of your company to crowdsource ideas, complete employee surveys, measure employee engagement and communicate through messaging and video chat services. It includes all Vocoli related online instances, such as websites, apps and related online services, known as the "Service."

The privacy policy describes how your information is collected, used and shared when you use the Service.

The Service is intended for use by for-profit and nonprofit employers and government agencies (known as the "Organization"), is provided as a technology tool by the employer, and is to be used in accordance with their instructions and policies. The Service may be customized by the Organization according to their requirements and may be administered by Moderators within the Organization with their specific logins, known as the "Instance."

Use of this platform and the specific Instance must be in accordance with the Service's Acceptable Terms of Use (AUT) and the Organization's policies.

In addition to abiding by the Service's terms of use and privacy requirements, your Organization is also responsible for the collection and use of any data that you submit or provide through the Service and such use is governed by the terms your Organization has in place with Vocoli.

In addition to this privacy statement, your Organization may have additional policies or codes of conduct which will apply in relation to your use of the Service. If you have any questions about your use of the Service, please contact the Moderator or administrator within your Organization.

I. WHAT KIND OF INFORMATION IS COLLECTED?

Your Organization will collect the following information when you, your colleagues or other users access the Service:

  • Your contact information, such as full name, email address, phone number and department
  • Your username and password
  • Segments within the Organization that you're a member of
  • Messages between you and other users, in formats such as text, pictures or videos
  • Responses to crowdsourced challenges, in the form of ideas and innovations
  • Responses to employee engagement surveys (note that the Organization will not see single responses to pulse surveys or surveys labeled as "anonymous" and will only see compiled survey results)

In common with other websites, log files are stored saving details such as the visitor's IP address, browser type, referring page and time of visit. Cookies may be used to remember visitor preferences when interacting with the website. Where registration is required, the visitor's email and a username will be stored on the server.

Data may be stored an unlimited amount of time, though Vocoli and the Organization reserve the right to delete and/or archive data within the terms of the Service/Customer relationship.

II. HOW DOES YOUR ORGANIZATION AND VOCOLI USE THIS INFORMATION?

Your organization shares information that it collects with Vocoli (as a provider of the platform) so the Service can provide a communication, feedback and innovation platform. They may share survey and idea results to other members of the Organization or to partners for the purpose of improving their business.

In addition, Vocoli may collect high-level trend data for certain employee engagement metrics and share it as a baseline with other customers. Individual data related to any individual or to any specific company will never be shared.

Examples of such might include:

  • A baseline of employee engagement trends and metrics within a certain industry, such as manufacturing so your Organization can compare their employee engagement data to an industry as a whole
  • A baseline of employee engagement trends and metrics for a certain time period within a certain geographic area.

The Organization has the option to opt-out of this broad trend sharing upon the creation or renewal of a contract and Vocoli may provide specifics to the operation of the broad trend sharing upon request.

III. DISCLOSURE OF INFORMATION

Your Organization discloses the information collected in the following ways:

  • to third-party service providers that assist in providing the Service or part of the Service;
  • to third-party apps, websites or other services that you can connect to through the Service;
  • in connection with a substantial corporate transaction, such as the transfer of the Service, a merger, consolidation, asset sale or in the unlikely event of bankruptcy or insolvency;
  • to protect the safety of any person; to address fraud, security or technical issues; and
  • in connection with a subpoena, warrant, discovery order or other request or order from a law enforcement agency.

IV. ACCESSING AND MODIFYING YOUR INFORMATION

You and your Organization may access, correct or delete information that you have uploaded to the Service using the tools within the Service (for example, your profile, your portfolio, your message list, or your activity log). If you are not able to do so using the tools provided in the Service, you should contact your Organization directly to access or modify your information.

V. THIRD-PARTY LINKS AND CONTENT

The Service may contain links to content maintained by third parties that your Organization does not control. You should review the privacy policies of each website that you visit.

Certain third-party advertising networks may use cookies to serve ads. Their use of cookies enables it to serve ads to visitors based on their visit to sites they visit on the Internet. Website visitors may opt out of the use of this cookie by visiting those ad network's specific network privacy policies. This may include networks such as Google, AdRoll, Retargeter, Fetchback and Chango.

VI. ACCOUNT CLOSURE

If you would like to stop using the Service, you should contact your Organization. Similarly, if you stop working for or with the Organization, the Organization may suspend Your Account and/or delete any information associated with Your Account.

It typically takes about 90 days to delete an account after account closure, but some information may remain in backup copies for a reasonable period of time. Please note that content you create and share on the Service is owned by your Organization and may remain on the Service and be accessible even if your Organization deactivates or terminates Your Account. In this way, content that you provide on the Service is similar to other types of content (such as presentations or memos) that you may generate in the course of your work.

VII. ACCEPTABLE USE

When accessing Vocoli or the Vocoli API, and in addition to your Organization's policies, you must comply with our acceptable use and platform policy. You must not:

  • Hide your identity, impersonate anyone else or misrepresent your affiliation with any person or entity
  • Engage in any activity that exploits, harms or threatens to harm children, animals, property or other humans
  • Create or display content that is illegal, discriminatory, harmful, fraudulent, deceptive or defamatory, or that promotes or encourages violence, violation of laws, self-mutilation, eating disorders or drug abuse
  • Violate laws or infringe the rights of Facebook or any third party
  • Interfere with the normal functioning of Vocoli or anyone else's use of Vocoli
  • Access Vocoli or related content or information through means that are not authorized by Vocoli (including through scraping or crawling); circumvent access controls; or otherwise attempt to gain unauthorised access to Vocoli or related systems, passwords or accounts
  • Share admin access tokens with or grant similar app access permissions to any third party that is not expressly approved by Vocoli. When you decide to grant such admin access, either via token or app permission, to an approved third party, you may allow the third party access to your data or content only to the extent necessary for the purpose approved by Vocoli and consistent with your instructions. We reserve the right to limit such third-party access (e.g. by resetting the access token or removing the app permission) at any time if we believe that such access has been or will be misused.
  • Upload viruses, malware or other malicious code, or do anything that could damage, disable, overburden or impair Workplace or related systems (such as a denial-of-service attack or interference with page rendering or other Workplace functionality)
  • Steal, or attempt to steal, ideas and innovations from other users.

Please also note that Vocoli is not directed to children aged less than 13, so if you are less than 13 years of age, you are not permitted to access or use the service.

VIII. CHANGES TO THE PRIVACY POLICY

This Privacy Policy may be updated from time to time. When updated the “Effective date" above will be amended and the new Privacy Policy will be posted online.
